These Terms of Service ("Agreement" or "Terms") establish the conditions under which the How2Burn AI application ("Application", "How2Burn", "We", or "Service") is made available to you, the user ("You" or "User"). By creating an account, using the application, or accessing our services, you agree to comply with and be bound by these Terms. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THE SERVICE. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE THE APPLICATION.

1. Eligibility

The Service is not intended for individuals under 18 years of age. By registering, you represent and warrant that (i) you are of legal age to form a binding contract; (ii) you will provide accurate and complete registration information; and (iii) your use of the Service is not prohibited by the laws of your jurisdiction.

2. Medical and Health Disclaimer (Critical Notice)

HOW2BURN AI PROVIDES INFORMATION, MONITORING, AND PRODUCTIVITY RESOURCES, BUT IT IS NOT A MEDICAL PROVIDER OR A SUBSTITUTE FOR MEDICAL ADVICE. THE APPLICATION DOES NOT REPLACE DIAGNOSES, TREATMENTS, OR GUIDANCE FROM A QUALIFIED HEALTHCARE PROFESSIONAL.

You expressly acknowledge that activities such as caloric restriction, dieting, and exercising involve inherent risks, which may result in bodily injury, severe illness, or death. You assume these risks entirely. You must consult a physician, nutritionist, or certified healthcare professional before starting, modifying, or stopping any diet or exercise program. The Service should not be used by pregnant women, individuals with a history of eating disorders, or individuals with chronic medical conditions without strict medical supervision.

Under no circumstances shall How2Burn, its creators, directors, or affiliates be liable for any injuries, health damages, or deaths suffered by you or third parties as a result of using the information, diets, estimates, or resources provided by the Service.

3. Artificial Intelligence ("Dr. Chama") and Data Accuracy

The Service utilizes advanced generative Artificial Intelligence provided by third parties (e.g., Google Gemini) to extract nutritional information from texts and photographs, as well as to generate motivational messages and evaluations. You understand and agree that:

4. Premium Subscriptions, Payments, and Automatic Renewal

The Service offers advanced features through paid subscriptions ("How2Burn Premium"). By purchasing Premium, you agree to pay the applicable fees charged through the Apple (App Store) or Google (Google Play) ecosystem.

Automatic Renewal: Unless stated otherwise at the time of purchase, your subscription will automatically renew at the end of each period (monthly or annually). The charge will be processed to your account 24 hours before the end of the current period. To prevent renewal, you must cancel the subscription in your Apple or Google account settings before this deadline. We do not offer refunds for processed fees and do not perform direct chargebacks; all billing disputes must be resolved directly with the respective app store (App Store / Google Play).

5. Intellectual Property Rights and License to Use

All texts, graphics, user interfaces, logos, trademarks (including "How2Burn"), algorithms, source code, and compilations present in the Service are the exclusive property of How2Burn or its licensors and are protected by copyright and intellectual property laws.

Prohibited Activities: You agree that you will not (i) copy, reverse engineer, decompile, or attempt to extract source code or API keys from the Service; (ii) use robots, spiders, or automated data extraction tools (scraping) on the application; (iii) use the Service to build a competing product, or to train third-party AI models and algorithms; (iv) publish or transmit malicious material, viruses, or hacking attempts.

6. Copyright and DMCA

We respect the intellectual property of others. If you believe that any content inserted in the application violates your copyrights, please notify us at support@how2burn.com with the formal requirements stipulated in the Digital Millennium Copyright Act (DMCA), including proof of rights ownership and the exact location of the alleged violation.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

In no event shall How2Burn or its affiliates be liable for any direct, indirect, incidental, consequential, punitive, or special damages (including lost profits or data loss) arising from the access, use, or inability to use the Service, even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to defend, indemnify, and hold harmless How2Burn, its administrators, executives, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from or in any way related to (i) your violation of these Terms; (ii) your misuse of the Service; or (iii) your violation of any laws or third-party rights.

9. Governing Law and Arbitration

These Terms shall be governed by the laws in force in the jurisdiction of the How2Burn developer's headquarters, regardless of conflict of law principles. Any dispute, claim, or controversy arising out of or related to this Agreement or the use of the Service shall preferably be resolved amicably and out of court. If resolution is not possible, the central forum of the application's official registration jurisdiction is elected to resolve disputes. You waive the right to participate in class actions against How2Burn; any claims must be brought strictly in an individual capacity.

10. Changes to the Terms

We reserve the right to modify these Terms at any time. Modifications will be effective upon posting in the Service. Your continued use of the application after such posting will constitute your acceptance of the changes.
